4 Important Facts You Should Know About Vaginal Mesh

If you or a loved one have had transvaginal mesh surgery, you may be eligible for compensation from the manufacturer. The US Food and Drug Administration (FDA) has issued a statement warning about serious complications associated with the surgical mesh used in transvaginal placement. In addition, the FDA has warned that transvaginal mesh may not be more effective in certain situations than non-mesh repairs which means for some patients they were subjected needlessly to a greater risk of adverse side effects.

What is Vaginal Mesh or Transvaginal Mesh?

Transvaginal mesh is a medical device used to repair weakened or damaged tissue and placed through the vagina. It is made from either porous or non-porous absorbable synthetic material or absorbable biologic material. Transvaginal mesh is used to repair pelvic organ prolapse (POP) by being permanently implanted to reinforce the weakened vaginal wall or used to treat stress urinary incontinence (SUI).
Pelvic Organ Prolapse occurs when the pelvic floor can no longer support the pelvic organs including the vagina, cervix, uterus, bladder, urethra, and rectum. The muscles and tissue of the pelvic floor may weaken with age or as a result of labor or childbirth. Other causes of POP are obesity, frequent constipation, or genetics. Symptoms of POP include pelvic pain, pressure, and bulging of tissue or organs.
Stress Urinary Incontinence (SUI) is the most common type of urinary incontinence for women. They will experience urine leakage during physical activity or when coughing or sneezing. SUI occurs when the pelvic muscles supporting the bladder and urethra become weakened. This weakness can be caused by pregnancy, childbirth, aging, obesity, or pelvic surgery.
There have been thousands of reports of complications associated with the use of transvaginal mesh to repair POP and SUI. As a result, the FDA conducted a review to evaluate the safety and effectiveness of transvaginal mesh. The review has shown that using transvaginal mesh for POP is no better than non-mesh repair. They are still evaluating the results for SUI transvaginal mesh surgeries due to the high volume of incidents.

The Four Issues Revealed by the FDA Review On Transvaginal Mesh

  1. Transvaginal mesh POP repair increases patient risks not found in traditional non-mesh POP repair.
  2. Transvaginal mesh surgery carries a higher risk of mesh complications than abdominal mesh surgery for POP repair.
  3. There is no evidence that using transvaginal mesh to support either the top or back wall of the vagina has any benefit to the patient over non-mesh treatment.
  4. There may not be any better symptomatic results when using transvaginal mesh to strengthen tissue between the bladder and vagina compared to traditional non-mesh POP repair.
The most commonly identified reported complication from transvaginal mesh surgery is the erosion of mesh through the vagina. This may require multiple surgeries to attempt to repair with sometimes less than satisfactory results.
Another complication from the use of transvaginal mesh is mesh contraction (shrinkage). This can result in vaginal shortening, tightening, and pain. Both mesh erosion and mesh contraction may cause severe pelvic pain as well as interfere with the woman’s ability to engage in sexual intercourse.

Studying Transvaginal Mesh Complications

Many women are experiencing complications after having transvaginal mesh surgery. While it won’t restore their health, now is the time to hire an experienced lawyer that will file a lawsuit against the manufacturers of this harmful device. For those that are suffering because of transvaginal mesh issues, they may be able to prevail in court.
The US Food and Drug Administration (FDA) has recently recognized that transvaginal mesh may cause patients to experience harmful side effects. The FDA has received over 4,000 complaints to date, and stated that they are concerned about the high number of adverse events reported. On July 13, 2011, the FDA issued an updated warning to health care providers and patients that surgical placement of mesh through the vagina to repair pelvic organ prolapse may expose patients to greater risk than other surgical options.
What Are the Common Complications?
The most common transvaginal mesh complications are the following:
  • Protrusion of mesh through the vagina
  • Pain
  • Infection in the treated area
  • Bleeding
  • Painful intercourse
  • Perforated organs
  • Difficulty urinating
These injuries can lead to neuro-muscular problems, scarring and emotional issues. In most cases, additional surgery is needed to attempt a repair of the damage done as a result of the original transvaginal mesh surgery.
The Transvaginal Mesh Debate
Surgeons use transvaginal mesh surgery usually to repair pelvic organ prolapse (POP) or stress urinary incontinence (SUI). POP is when the tissues that hold the pelvic organs in place become damaged or weakened. This can lead to SUI which is a leakage of urine during physical activity. According to the FDA, 30 – 50 percent of women may develop POP. Unfortunately, the intended cure for their original medical issue can cause a lifetime of physical and mental problems.
If you are experiencing the debilitating complications of transvaginal mesh surgery, you may be entitled to receive monetary compensation. It is a good idea to speak to an attorney to find out if you may have a case that can be taken to court.
Women who have had this surgery were not expecting that their health would be made worse afterwards because of transvaginal mesh. These same women need to consider hiring an attorney for a possible lawsuit. A patient who is suffering from transvaginal mesh complications of any kind is certainly within her rights to file a lawsuit against the transvaginal mesh manufacturer.
The Statute of Limitations
Victims of transvaginal mesh surgery must not wait too long to contact an attorney if they are experiencing complications. There is a statue of limitations to file your case so you will want to find out now if you might have a claim for your injuries.
Who Can File a Lawsuit?
After it has been determined that transvaginal mesh is the cause of their symptoms, women often need to have several surgical procedures to correct the damage. These women may be entitled to compensation and should consider filing a lawsuit for their transvaginal mesh injuries.
Any patient who feels as if her condition was made worse due to transvaginal mesh implants is encouraged to contact an experienced transvaginal mesh lawsuit attorney and discuss their options.

Filing a Transvaginal Mesh Lawsuit

There are many women who have become victims of the complications related to transvaginal mesh. Some of these same women may be suffering in silence, unaware that they are justified in filing a transvaginal mesh lawsuit.
The US Food and Drug Administration (FDA) is now warning the public that reports of complications with transvaginal mesh are increasing. Because of this warning, patients that have had a transvaginal mesh surgery and suffered injury as a result may now be able to file a lawsuit. Winning a transvaginal mesh lawsuit could repay lost wages, damages, and staggering medical bills that were a result of transvaginal mesh injuries.
What is transvaginal mesh?
Transvaginal mesh is a medical device that is permanently implanted to reinforce the weakened or damaged vaginal wall. This is done usually to repair pelvic organ prolapse (POP) or to treat stress urinary incontinence (SUI).
Transvaginal mesh is inserted through the vagina rather than the typical insertion through surgery in the abdomen. The FDA has announced that they are not convinced that using transvaginal mesh has any advantages over implanting through the abdomen and also that serious risks from transvaginal mesh is NOT rare.
Problems related to vaginal mesh
In 2008, the FDA issued their first warning after receiving around 1000 complaints that claimed transvaginal mesh had caused patients serious complications. These complaints continued to grow and in July of 2011, the FDA finally released a safety warning about the use of transvaginal mesh. This warning informed women and their health care providers of the risks that were associated with vaginal mesh products. The safety communication stated that the risks of transvaginal mesh had the potential to outweigh the benefits. In January of 2012, almost four years after the initial claims, the FDA ordered 33 manufacturers to perform research studies on their products to determine their safety, effectiveness, and risks.
Cases against vaginal mesh manufacturers
Many women in the United States have filed claims against the various manufacturers of transvaginal mesh. These implants are accused of causing a multitude of problems, including but not limited to tissue damages, internal scarring, bowel and bladder perforation, and damage to the blood vessels. In addition, additional surgeries are often required to repair the injuries caused by the mesh products.
What are the requirements to qualify for a lawsuit?
If you have had transvaginal mesh surgery and experienced complications or required additional surgery because of the mesh, you may qualify for compensation by the manufacturer. The FDA has released information warning the public about the complications of transvaginal mesh. Those who have had transvaginal mesh implanted and have experienced any complications should talk to an attorney to see if they qualify to file a transvaginal mesh lawsuit.
What are the complications women may experience?
The rate of complications related to transvaginal mesh is high. Some of the most common complications listed among the women who have filed a transvaginal mesh lawsuit include vaginal mesh erosion, infection, urinary problems, blood vessel damage, pelvic prolapse or incontinence recurrence, pain or discomfort, vaginal scarring, and perforation of the bowel, bladder, or blood vessels. A woman who is experiencing any of these complications may qualify to file a transvaginal mesh lawsuit.
Statue of Limitation for Transvaginal Mesh Lawsuits
There is typically a time limit for which an individual can file a lawsuit in order to receive compensation. This can vary from state to state. The statue of limitations for transvaginal mesh lawsuits usually ranges between one and six years, with a few states allowing as many as ten years to file a lawsuit. You must file a lawsuit within this period of time to qualify. If one cannot file a lawsuit for themselves for any reason, it may be possible to have a family member file instead. For example, if your loved one is either not capable of filing their own lawsuit or has died, you may be able to file on their behalf.
Types of lawsuit claims
Transvaginal lawsuits may be classified as class action lawsuits and/or personal injury lawsuits. In a class action lawsuit, the attorney is addressing the interests of the entire group as a whole. In a personal injury case, the lawsuit is focused on your personal experience, claims, and injuries.
The similarity lies in the fact that both cases attest that the manufacturer of the product did not hold up their duty to provide a safe and effective product. The maker of the device may not have designed the product with regards to the safety of the patient or adequately warn about the severity of risks associated with the product. This is just cause for a lawsuit.

The vaginal mesh lawsuit involving Ms. Linda Gross and Johnson & Johnson subsidiary Ethicon has been followed closely from the start. This was the first vaginal mesh injury lawsuit to go to trial with hundreds more pending. It is obvious that this first case will likely have a big impact on the future of vaginal mesh lawsuits and potential settlements.

The jury in the case has spoken loud and clear in the plaintiff’s favor. The jury at the Superior Court of Atlantic County in New Jersey awarded Ms. Gross $3.35 million in compensatory damages. This is a huge blow to defendants Johnson & Johnson and Ethicon, as well as all the other vaginal mesh implant manufacturers.

It is not clear what the actual ramifications will be from this settlement victory but it could be substantial for other plaintiffs across the nation. This could mean larger settlement payouts as vaginal mesh implant manufacturers do all that they can to avoid the courtroom. It could also mean vaginal mesh injury settlements will be reached quicker as they have gotten a clear view of what a jury’s stance may be.

This victory may also increase the overall number of cases filed. As this particular plaintiff receives national attention it is likely that more awareness will be brought forward regarding how dangerous these vaginal mesh implants can be and also provide reassurance to victims of mesh side effects that they too can receive the compensation they deserve for the injuries they sustained.

Vaginal mesh and bladder sling implants are frequently used to treat pelvic organ prolapse and stress urinary incontinence. However, the vaginal mesh has been known to actually harden, which causes scaring as well as inflammation in the tissue.

There are a number of very serious side effects that women experience when their vaginal mesh implant goes wrong. These include the following:

  • Erosion of vaginal tissue
  • Perforation of organs
  • Severe pain
  • Vaginal bleeding
  • Vaginal scaring

In Ms. Gross’ case it took 18 surgeries so far to correct the side effects her Ethicon vaginal mesh implant caused. This was likely a huge factor in the jury’s decision as there were reports that the jury stopped their deliberation to have her testimony read back to them.

Now that this first vaginal mesh lawsuit has gone to trial it is very important that those who have been victims of vaginal mesh side effects file their own lawsuit right away. This vaginal mesh settlement verdict could really encourage manufacturers to speed up the settlement process and you do not want to miss out on the compensation you deserve for the pain and suffering you have been forced to endure.
